PROMOTION TERMS AND CONDITIONS

Thank you for your interest in the Promotion! The following sets out the Promotion terms and conditions, which comprises the Schedule and Standard Terms (together, “Terms and Conditions”). Entry into the Promotion is deemed acceptance of these Terms and Conditions, and entries must comply with these Terms and Conditions to be valid.

SCHEDULE

STANDARD TERMS AND CONDITIONS:

1. Information on the Promotion, eligibility, mechanisms and the Prize Pack are set out in the Schedule.
2. Unless the context otherwise requires, any capitalised terms used in these Standard Terms and Conditions shall have the meaning given to them in the Schedule.
   
   Entry and Eligiblity
3. To enter into this Promotion, you must comply with the Entry Requirements and Entry Procedure. Entries which fail to do so will not be accepted by BBCS.
   
   Prize Pack
4. Prize Packs will be awarded in accordance with the Draw Details. If any Prize Pack: (a) remains unclaimed in accordance with the timeframe stipulated in the Draw Details above; or (b) is otherwise forfeited despite BBCS making reasonable efforts to notify the winner, BBCS may deem any winner as ineligible to receive the Prize Pack. In that event, BBCS will reconvene after one month in order to distribute any unclaimed Prize Packs or re-draw winners.
5. All RRP values stated in the Schedule are based on information provided by suppliers and is correct as at the publishing date. BBCS is neither responsible nor liable for any changes in the value of the Prize Pack occurring between publishing date and date the Prize Pack is claimed. All Prize Pack values are in Australian dollars. All taxes (excluding GST) which may be payable as a consequence of receiving a Prize Pack are the sole responsibility of the winner.:
6. The Prize Pack winner must comply with any conditions of use of the Prize Pack and the Prize Pack manufacturer or suppliers’ directions or requirements. BBCS makes no warranties or representations about the fitness for purpose or suitability of any Prize Pack and will not accept responsibility for the quality or fitness for any purpose of any Prize Pack, or the failure of any Prize Pack to be of merchantable quality.
7. The Prize Pack is non-transferable and is not redeemable for cash. The Prize Pack or any element of the Prize Pack cannot be exchanged for any other Prize Pack. The contents of the Prize Pack will be at BBCS’s sole discretion. The Prize Packs are subject to availability and the terms and conditions of the entities supplying the Prize Packs.
8. No responsibility will be taken by BBCS, the Associated Agencies or their related bodies corporate for any changes in dates, times or cancellations or other arrangements that may prevent the Prize Pack winner from winning the Prize Pack or using the Prize Pack.
   
   Checks and Disqualification
9. You hereby agree to provide BBCS or BBCS’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize Pack winner or if reasonably requested by BBCS or the BBCS’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of BBCS. In the event that a Prize Pack winner cannot provide suitable proof, the Prize Pack winner will forfeit the Prize Pack in whole and no substitute will be offered. BBCS reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this Promotion.
10. Without prejudice to its rights under Clause 7, BBCS reserves the right, in its absolute discretion, to disqualify: A) any entry which, in BBCS’s option, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or B) any individual who tampers with the entry process, submits an entry that is not in accordance with these Terms and Conditions or who has in BBCS’s opinion, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Promotion or is generally damaging to the goodwill or reputation of BBCS.
    
    Cancellation / Variation
11. BBCS reserves the right, in its absolute discretion, at any time before the awarding of the Prize Pack to cancel or vary the Promotion or to cancel or vary the Prize Pack in any circumstances, including, without limitation, circumstances where in BBCS’s opinion (which it shall form in its absolute discretion): A) a Prize Pack winner does not satisfy the Promotion entry requirements; or B) BBCS cannot conduct the Promotion or award the Prize Pack for any reason beyond its control.
12. In the event that BBCS cancels or varies the Promotion or varies or withdraws the Prize Pack, it shall not be: A) liable to any person for any costs, loss or damage (including costs, loss or damage caused by any negligence) arising out of, in connection with, such cancellation, variation or withdrawal; or B) required to conduct the Promotion at any other time.
13. By entering the Promotion, you consent to BBCS may collecting, using, and/or disclosing to third parties, your personal information (as the defined in the Privacy Act 1988 (Cth)) for the purposes of conducting this Promotion and those stated in accordance with BBCS’s privacy policy (available at: https://www.bbcstudios.com/privacy) including to: A) determine and notify winners; B) administering Prize Packs; C) for future promotional, marketing and publicity purposes (without any further reference or payment to you); and D) comply with local law requirements, including to disclose your personal information to Australian state and federal lottery departments, and publish your name as winner if required under the relevant lottery legislation.
14. In connection with clause 13(b), you consent to your name, image, biography and entries (including but not limited to, any written answers, photographs/images and audio-visual recordings) being reproduced, published communicated, broadcast or shown to the public by BBCS in any media for its promotional purposes, without compensation. For this purpose, you grant to BBCS a non-exclusive, perpetual, worldwide, and royalty-free licence in any such written answers, photographs/images and audio-visual recordings. You hereby consent to any act of omission by BBCS which may infringe any of your moral rights (within the meaning of the Copyright Act 1968 (Cth)), including i) failing to attribute (or correctly attribute) your authorship of the entry; or ii) making any modifications, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.

    General
16. Conduct of Promotion. A decision of BBCS in relation to the conduct of the Promotion is binding and conclusive and no correspondence will be entered into.
17. Third Party Social Media Sites. Entry and continued participation in the Promotion is dependent on you following and acting in accordance with the Facebook Terms of Service, which can be viewed at https://www.facebook.com/legal/terms. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Meta. You understand that you are providing their information to BBCS and not to Meta. The information that you provide will only be used for the purposes contemplated in these Terms and Conditions. Any questions, comments or complaints about this Promotion must be directed to BBCS and not to Meta. You unconditionally and irrevocably release and discharge Meta from any and all liability in relation to this Promotion.
18. Submission of Entries and Information. You must ensure that all information submitted to BBCS is current, timely and accurate. No responsibility will be accepted by BBCS for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into BBCS’s database and NOT time of transmission by the entrant. BBCS accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
19. Liability. You enter the Promotion at your own risk. With the exception of liability which cannot be excluded by law, BBCS shall not be liable for (and the Prize Pack winner agrees to release BBCS from liabilities related to) any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury or sickness suffered or sustained as a result of accepting or using the Prize Pack or entering the Promotion.
20. Governing Law and Jurisdiction. These Promotion Terms and Conditions shall be governed by and in accordance with the laws of New South Wales. The parties submit to the exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts over any claim, dispute or matter arising under or in connection with these Terms and Conditions (including non-contractual disputes or claims).
